New Ministerial Instructions and Minister’s Personal Procedural Decisions

​​​​​The Minister for Immigration and Citizenship has made new Ministerial Instructions and Personal Procedural Decisions (PPD) under sections 351, 501J, 46A and 48B of the Migration Act 1958.

On 4 September 2025 and 17 September 2025, the Minister for Immigration and Citizenship, the Hon Tony Burke MP, issued new instructions on the use of Ministerial Intervention powers under sections 46A, 48B and 351, 501J of the Migration Act 1958. These instructions took immediate effect and they replace the 2016 Ministerial guidelines for sections 351, 501J, 48B and the 2017 Ministerial guidelines for section 46A.

On 4 September 2025, the Minister made PPDs about individuals w​​ho lodged requests for Ministerial Intervention before that date.​​ If you have an active Ministerial intervention request and this applies to you, the Department will notify you of the outcome.

You can make a new request if your case has been finalised. New requests will be assessed under the new instructions.
